Terms and conditions for the supply of Product(s) through the Seraphic Diamonds online store, www.seraphicdiamonds.com. For the purpose of these Terms and Conditions (“Terms of Use”), wherever the context so requires, i) The term ‘You’, ‘Your’ & ‘User’ shall mean any legal person or entity accessing or using the services provided on this Website, who is competent to enter into binding contracts, as per the provisions of the Indian Contract Act, 1872; ii) The terms ‘We’, ‘Us’ & ‘Our’ shall mean the Website www.seraphicdiamonds.com and/or the Partnership Seraphic Diamonds, as the context so requires. iii) The terms ‘Party’ & ‘Parties’ shall respectively be used to refer to the User and the Company individually and collectively, as the context so requires, iv)  The terms “Product” and “Products” shall respectively be used to refer to any item listed for sale on Our Website or ordered by You.

By placing Your order with us you are accepting these Terms and Conditions. Where You do not accept these Terms and Conditions in full, You do not have permission to access the contents of this website and should cease using it immediately.

By visiting Our site and/or purchasing something from us, you engage in Our “Service” and agree to be bound by the following Terms of Use, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Use apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

ABOUT OUR HOSTING SERVICES

Our online store is hosted on Woo Commerce. They provide us with the online e-commerce platform that allows us to sell Our Product(s) and services to you.

SITE ACCESS AND CHANGES

The Company reserves the right to modify or terminate any portion of the website or the services offered by the company for any reason, without ant prior permission or intimation to the User and without liability to the User or any third party. The User expressly agrees that any such amendments or modifications shall come into effect immediately. The User has a responsibility to periodically check the terms for changes. If the User continues to use the Website following such a change, the User will be deemed to have consented to any and all amendments / modifications made to the Terms. If the website faces a downtime for any length of time, we will not be liable for any reason.

CONTRACT

No contract will exist between you and Seraphic Diamonds for the sale of any Product unless and until Seraphic Diamonds has accepted your order with a confirmation email and a full payment or part payment is received from You by Seraphic Diamonds. A legally binding contract between us is created when we accept your order.

The User represents and warrants that he/she is competent and eligible to enter into legally binding agreements and that he/she has the requisite authority to bind himself/herself to these Terms, as determined solely by the provisions of the Indian Contract Act, 1872. The User may not use this Website if he/she is not competent to contract under the Indian Contract Act, 1872, or is disqualified from doing so by any other applicable law, rule or regulation currently in force.

Seraphic Diamonds reserves the right not to accept your order in the event that we are unable to obtain authorisation for payment or if shipping restrictions apply to a particular item, if the item ordered does not meet Our quality control standards and is withdrawn, out of stock or if there is an error in pricing or content. We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at Our sole discretion. We will not be liable for any indirect or consequential loss, damage or expenses arising from not accepting your order and we shall have no liability to you, by way of compensation, other than to refund the amount paid for the Product(s) in question within 30 days following the date of payment.

PRODUCT INFORMATION

The Company is diligent in presenting Product information, descriptions, and images on the website, but cannot be held liable for any errors or omissions in the information provided. The images on the website are for illustration purposes only. The website offers lab-grown diamond jewellery for personal use, including both customized and ready-made pieces. Please note that due to screen defaults and photography techniques, some items may appear larger or smaller than their actual size on the website. In some cases, items may be represented larger than their actual size to better display details, or smaller to show the entire item. The Company will not be responsible for any legal disputes arising from these representations.

PRICES

The cost of taxes and delivery will be displayed and included in the final invoice along with the Product price. The company reserves the right to change its prices at any time, and this will be noted on the order when placed. If an obviously incorrect price appears on Our website and it is not rectified at the time of check out for whatever reason (technical error, human error etc.), your order will be cancelled and payment will be refunded, even if it was previously confirmed.

ORDERS

To make a purchase on the website, User(s) may need to register and provide information such as their Permanent Account Number (PAN) and/or GST number. Full or at least 50% of the invoice value payments must be received by the company to complete an order, unless otherwise stated. Seraphic Diamonds uses one or more third-party payment gateways for the purpose of payment collection. The User can choose to pay online through Our secured third-party payment gateway provider. The User hereby agrees to the terms and conditions and privacy policy of the payment provider.

The User agrees to provide accurate and legitimate credit card information for the purpose of using the website’s services. The User must only use their own credit card for transactions and will not share this information with third parties unless required for fraud prevention or by law. The Company will not be held responsible for any credit card fraud and the User will be held responsible for any illegal use of a credit card and the onus to ‘prove otherwise’ shall be exclusively on the User.

The Company has the right to recover the cost of the Product(s), collection expenses, and attorney’s fees from the Users and/ or persons who fraudulently used the Website. The Company may also take legal action against such individuals for their fraudulent use of the Website and any other actions that violate the terms and conditions.

MODE  OF PAYMENT

The following payment options are available on the Website through are third party payment gateway:

1. a) Domestic and international credit cards issued by banks and financial institutions that are part of the Visa, Master Card & Amex Card networks;
2. b) Visa & Master Card Debit cards;
3. c) Netbanking/Direct Debit payments from select banks in India. A list of available options will be made available at the time of ‘checkout’.
4. d) Payment through UPI

As prescribed by the financial institutions issuing the credit or debit cards affiliated with Visa / Master Card / Amex, the User will required to submit his/her 16-digit card number, card expiry date and 3-digit CVV number while making an online transaction. The User must also have enrolled his/her card with VBV (Verified by Visa) or MSC (MasterCard Secure Code) in order to complete the transaction. The User is hereby expressly made aware that his/her card statements will reflect that a payment has been made in favour of Seraphic Diamonds. Third party payment gateways will be used for all services in Our site. To place a valid order on the Website, the User is required to complete the transaction, including making full or part payment for the Product / services opted for. This may or may not be assisted with a phone call from a customer service representative. By placing an order on the site or over the phone, the User expressly agrees to the terms and conditions and payment policy published in the appropriate section of the Website, or affiliated websites where reference to such affiliated websites has been specifically made.

After the user has added Product(s) / services to the shopping cart, and proceeded to the checkout section, the user will be asked for his/her preferred delivery address and other contact information. Once the payment transaction has been successfully completed, the user’s order will be processed on receipt of the funds from the user’s bank or the credit card company. It is at this stage that the users order is successfully placed. Thereafter the Product(s)/ services purchased by the user will be shipped based on the Product availability and completion of logistics operations related to the same.

Seraphic Diamonds may, at its sole discretion, request the customer to pay a percentage of the value of the transaction as an advance at the time of placing the order. The balance payment for the order shall be paid by the customer at the time of delivery of the Product.

Failure to pay the balance amount at the time of the delivery of the Product shall be treated as a cancellation of the order.

We shall be under no liability whatsoever with respect to any loss or damage arising directly or indirectly out of the authorization of any transaction being declined, on account of the cardholder having exceeded their pre-set limit.

AVAILABILITY

We will always do our best to fulfil your order once payment has been received. If an item becomes unavailable after your order has been confirmed and paid, we will issue a refund for the cost of the item within 30 days of payment. If part of your order is temporarily out of stock, we will send the available items first and the rest when they become available. We may offer a replacement for an unavailable Product, of equal price and quality, and if choose to decline, we will reimburse the cost of the unavailable Product, if it is permanently out of stock.

 

DELIVERY

The Company strives to meet the delivery schedule indicated on its website, however, it cannot be held liable for the consequences of a delayed delivery or loss of a package due to factors beyond its control, such as a third-party delivery service, the recipient, or an unexpected event or natural disaster. In the event that the package is not received, the Company will initiate an investigation with the carrier, which may take several days after receiving your complaint. During the investigation, there will be no refund or re-delivery.

When placing an order, the User must provide the full name of the recipient as it appears on their government-issued photo ID. Upon delivery, in order to collect the Product, the recipient must present any of the following government-approved photo identification card:

1. 1. AADHAR Card
   2. Permanent Account Number (PAN) card;
   3. Driver’s License;
   4. Voters Identification card; or
   5. Passport.

The Company/courier agent will only make the delivery after confirming the photo ID and name of the recipient. To ensure a safe delivery, the recipient’s government-approved photo identification will be verified. The recipient must provide a valid photo ID to the courier agent. If the User wants someone else to receive the delivery, they must specify this information when placing the order. The delivery will only be made to the specified person and the recipient details cannot be changed after the order is processed.

The Company will cover all shipping and local charges for the delivery of the Product(s). If the recipient is unavailable during the initial delivery attempt, the Company or courier will make three additional attempts before returning the Product. The cost of re-shipping and handling due to non-delivery will be the responsibility of the User.

DEFECTIVE AND DAMAGED ITEMS

The User/Recipient must inspect the delivered package before accepting it and shall not accept the delivery if the packaging appears to have been tampered with. The recipient has the option to open the package and verify its contents before accepting the delivery or signing the delivery receipt. They should not accept the delivery if the box is empty, the contents are damaged, or the contents do not match the ordered items.

Upon signing the delivery receipt, the recipient confirms that they have received the Product in accordance with their order from the Company. The Company is not liable to the User/ recipient for any refund or replacements about the delivery after it has been signed for.

If the User/ Recipient later discover that the Product(s) are missing or damaged during delivery, we may not be able to claim compensation from the courier or Our insurance company. In this case, You agree to bear full responsibility for the loss or damage and release us from any claims related to it to the fullest extent permitted by law.

In case you receive a defective, damaged, or incorrect Product(s), please contact us within 5 (five) business days. We will promptly work towards resolving the issue by replacing the Product)s) once the faulty Product(s) has been shipped back to us through Our shipping partners.

CERTIFICATE

The diamonds in the jewellery/mounts will not come with individual certificates unless specified when placing the order. The entire piece of jewellery will be certified by a third-party certifying authority.

BUY-BACK AND EXCHANGE POLICY

Seraphic Diamonds offers a Lifetime Exchange/Buyback policy for the Product(s) sold only in India subject to review by Our Quality Assurance Department of the Company for the Product free from any sort of damage/ wear/alteration/re-size etc. The decision by the Quality Assurance Department of the Company shall be Final and binding for any sort of Life-Time Exchange/Buy Back Scheme.

To avail the Lifetime Exchange/ Buyback policy, Seraphic Diamonds shall require the following:

• Original Product
• Original Product Certificate (If Any)
• Warranty Card (If Any)
• Original/Copy of the Invoice
• Valid Government. Id Proof of the person making the Exchange/ Buyback Request.

To ship the Product under the Lifetime Exchange/ Buyback policy, the Product should be packed safely in a box or a padded envelope and bubble wrapped so that it is secured from damage during transit.

In case of Re-Shipping the Product(s) under Life-Time Exchange or Buy-back Scheme, The Product should be couriered back to Us only through Our shipping partners.

The terms and conditions for the Lifetime Exchange scheme are as follows:

• • The Company offers an Exchange policy to the end Customers. Under this scheme, the Product(s) can be exchanged by every Customer for another Product(s) with a value equivalent to the following of the Product(s) being exchanged:
    • 100% of the prevailing gold market value or any other metal used PLUS
    • 70% of the prevailing market value of the lab grown diamonds of the same quality, studded in the jewellery

• • On accepting the Product(s) for exchange, the Company shall provide the exchanged Product(s) of the derived value of the Product being exchanged as mentioned above.
  • The Product(s) being exchanged should be accompanied with the original certificate; original invoice provided by Us along with the Warranty Card. The Company does not cover any consequential loss or damage of jewellery or precious stone in studded jewellery.
  • Life-Time Exchange shall not be applicable to order pertaining to Product(s) sold outside India.
  • The value of the Product being returned under this scheme will be determined only after a quality check is completed by Our Quality Assurance department of the Product shipped back. If your Product shows any sign of alteration (not done by Seraphic Diamonds) or damage, it will not be accepted for exchange or buyback.
  • Additional Logistic fee of Rs 1,500/- shall be deducted while determining the exchange Value.
  • New order shall be Shipped in Exchange within 21 days after receiving the Original Product.
  • No monetary refunds will be provided if the new item is priced lesser than the exchange item.
  • Seraphic Diamonds has the right to decide the final price of the exchange/buyback Product based on their inspection.
  • If the Product was originally bought at a discounted price, then an equivalent amount of the discount will be deducted from the new Product valuation, under the Lifetime Exchange/Buyback policy.

The terms and conditions for the Lifetime Buy-Back scheme are as follows:

• • The Company offers a Buyback policy to the end Customers. Under this scheme, the Product(s) can be returned by every Customer for a refund payment of the with a value amounting to:
    • 100% of the prevailing gold market value or any other metal used PLUS
    • 70% of the prevailing market value of the lab grown diamonds of the same quality, studded in the jewellery
  • If the Product was originally bought at a discounted price, then an equivalent amount of the discount will be deducted from the new product valuation
  • Making and certification charges (if any) shall be deducted during the new valuation of the Product under the Lifetime Exchange/Buyback policy.
  • The refund amount shall exclude all applied taxes at the time of purchase
  • The buyback scheme and re-imbursement of payment shall be subject to the quality check carried out of the Product(s) by the Company.
  • The Product(s) should be accompanied with the original certificate, the original invoice provided by Us and the Company’s Warranty Card (if any).
  • Buy Back shall not be applicable to order pertaining to Product(s) sold outside India.
  • Additional Logistic fee of Rs1500/- shall be deducted while determining the Buy Back Value.
  • All payments for the buyback value paid by the Company will be made through RTGS or NEFT only. Payments shall be made only to the person/entity mentioned in the invoice issued by the Retailer and carrying a valid Government Issue photo ID and valid Certificate of the Product.
  • The payment for the buyback of the Product shall be done through NEFT or RTGS only, in the name of the customer mentioned in the original invoice issued by Us.
  • The Refunds and payments under this scheme will be made within 21 business days of receipt of the original Product at Our office.

RETURN POLICY

Users have the option to return the purchased Product within 7 (seven) days of receiving their order. The Company promises to refund the entire amount (up to INR 1,00,000) either to the original payment method (Credit Card/Debit Card/Net banking) or through NEFT/RTGS transfer under the same name as on the invoice.

We will accept returns only when the Product is accompanied by the original Product Certificate (if any), the original Invoice and the Warranty Card (if any)  sent by Us at the time of delivery. 

We do not accept a return that displays signs of wear, alteration or resizing. Also, the Product(s) returned to Us with any physical damage on the jewellery piece or diamonds will not be eligible for return. 

If any coupon, discount offer or promotional codes have been used during the original purchase of the Product(s) you intend to return to us, the amount equivalent to such coupon, discount or promo code will be deducted from the refund amount, as applicable. 

For refunds within 7 (seven) days of receiving the order, the refund will be made via online bank transfer to the customer’s bank account within 21 working days after the Product is received. If the original payment was made through online debit/credit card/net banking, the refund will be made by reversing the transaction. For returns within 7 (seven) days, the customer will be responsible for paying a shipping fee of INR 750 for the Product(s) under this policy.

We have the discretion to alter this policy at any moment, kindly revisit it often. Updates and modifications will be effective immediately upon being posted on the website. In case of significant changes to this policy, we will inform you through this platform to ensure you stay informed about the data we collect, how it’s utilized, and in what instances, if any, we may use or reveal it.

DISCLAIMER

By accessing the services on the website and engaging in transactions, you acknowledge and agree that you are doing so at your own risk and using your best judgment. The Company will not be held responsible for any violations of third-party rights committed by a user on the site.

FEEDBACK AND COMMENTS

Cessation of Operation. Seraphic Diamonds may at any time, in its sole discretion and without advance notice to you, cease operation of the Website and distribution of the Product(s).

Entire Agreement. This Agreement comprises the entire agreement between you and Seraphic Diamonds and supersedes any prior agreements pertaining to the subject matter contained herein.

Effect of Waiver. The failure of Seraphic Diamonds to exercise or enforce any right or provision of this Agreement will not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect.

Governing Law; Jurisdiction. This Website originates from the city of Mumbai in the state of Maharashtra in the country of India. This Agreement will be governed by the laws of India without regard to its conflict of law principles to the contrary. Neither you nor Seraphic Diamonds will commence or prosecute any suit, proceeding or claim to enforce the provisions of this Agreement, to recover damages for breach of or default of this Agreement, or otherwise arising under or by reason of this Agreement, other than in courts located in the city of Mumbai in the state of Maharashtra. By using this Website or ordering Product(s), you consent to the jurisdiction and venue of such courts in connection with any action, suit, proceeding, or claim arising under or by reason of this Agreement. You hereby waive any right to trial by jury arising out of this Agreement and any related documents.

Statute of Limitation. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Website or Product(s) or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.

Waiver of Class Action Rights.
